Intellectual Property law

The software that powers a platform, the music behind a streaming service, the brand of a blockchain project, the copyright in an AI-generated work — digital IP raises questions that demand technical understanding as well as legal depth. We have advised at this intersection since 2010.

01

Copyright and authors’ rights

The full scope of copyright and authors’ rights under Luxembourg and EU law — ownership, duration, moral and economic rights, licensing arrangements, and infringement claims. Specific experience in music and entertainment copyright, collective management organisations, and code ownership in employment and contractor relationships.

03

Trademarks and brand protection

Registration strategy at EUIPO and national level, clearance searches before brand launches, management of international portfolios, and infringement proceedings before Luxembourg courts and EUIPO. In the digital sector, brand disputes frequently involve domain names, social media handles, and comparative advertising online.

05

Domain names and online brands

Unauthorised use of a trademark in a domain name, a social media username, or a sponsored search result is an infringement with specific remedies. We act in UDRP and ADR.eu dispute procedures and on the registration and enforcement of .lu domain rights

02

AI and copyright

Whether AI-generated outputs attract copyright protection, who owns them if they do, and the boundaries of the text and data mining exceptions that allow training data to be used. We advise developers of AI systems, users of AI-generated content, and rights-holders whose works appear in training datasets.

04

Software and database rights

Software copyright, database rights, open-source licence compliance, software escrow arrangements, and the IP provisions in development and licensing agreements. We also advise on the legal treatment of APIs, algorithms, and proprietary datasets.

06

IP litigation and enforcement

Representation before Luxembourg courts — actions for infringement of copyright, trademarks, and database rights, applications for interim injunctions, and cross-border enforcement. We also advise on customs seizures for infringing goods and multi-jurisdiction enforcement programmes for major rights-holders.
